1. Agreement to these terms
These Terms of Service (the “Terms”) are a binding agreement between you and Bisaic, Inc. (“Bisaic,” “Realm,” “we,” “us,” or “our”) governing your access to and use of Realm’s websites, applications, games, sessions, and related services (the “Service”). By creating an account, joining a session, purchasing a plan, or otherwise using the Service, you agree to these Terms and our Privacy Policy.
If a separate signed agreement between Bisaic and an organization governs your use, that agreement controls to the extent it conflicts with these Terms.
2. Eligibility and authority
You must be at least 13 years old to create a Realm account. If you are under the age of majority where you live, you may use Realm only with permission from a parent or legal guardian and under any supervision required by your organization. The Service is not offered directly to children under 13 unless an organization has a written agreement with us and has satisfied applicable parental-consent requirements.
If you use Realm for an organization, you represent that you have authority to accept these Terms for that organization. If you invite participants, create location-based Games, Sessions, or Challenges, or enable submission review or AI features, you also represent that you have authority and all notices and permissions needed to do so.
3. Accounts and workspaces
- Provide accurate account information, keep your sign-in methods secure, and promptly notify us of suspected unauthorized access.
- You are responsible for use of your account and for the roles, invitations, visibility, join policies, and settings you control.
- Workspace owners and administrators may manage membership and access, view workspace Sessions, Challenges, and Reports, and control organization content according to their role.
- Guest reconnect credentials and join codes are access credentials. Do not publish or share them beyond the intended participants.
An organization may suspend or remove your access to its workspace independently of your Realm account. A workspace owner is responsible for transferring ownership before leaving or requesting deletion when other members depend on that workspace.
4. The Service
Realm provides tools to create and publish Games, configure missions and map areas, draft content with AI, host live Sessions or self-started Challenges, collect submissions, review results, and manage teams or groups. Features may vary by plan, location, device, or workspace configuration.
We may improve, add, change, or discontinue features. We will use reasonable efforts to provide notice before a material reduction to a paid Service when practical. Realm is not an emergency, navigation, dispatch, attendance-certification, or life-safety service, and no feature guarantees a participant’s identity, presence, or physical safety.
5. Content and permissions
Your content
As between you and Realm, you or your organization retain ownership of content you create or submit, including games, instructions, maps, responses, and media (“User Content”). You grant Realm a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, display, and adapt User Content only as needed to operate, secure, support, and improve the Service and fulfill your settings and instructions.
Your responsibilities
You represent that you have the rights and permissions needed for User Content and its use in Realm. Do not upload confidential, regulated, copyrighted, biometric, health, or other sensitive information unless your organization has approved that use and has an appropriate agreement and lawful basis. You are responsible for participant notices, releases, and consents for photos, precise location, and other personal information you ask Realm to collect.
Feedback and official templates
If you send feedback, you grant us a perpetual, irrevocable, royalty-free right to use it without restriction or compensation. Realm and its licensors own the Service, software, branding, documentation, and official templates. We grant you a limited, revocable, non-transferable right to use them only through the Service under these Terms.
6. Acceptable use
You may not use the Service to:
- break the law, violate another person’s rights, or breach a contract;
- harass, threaten, exploit, surveil, or endanger another person;
- collect location, photos, or personal information without required notice and consent;
- upload malware or material that is unlawful, infringing, deceptive, or abusive;
- probe, bypass, or interfere with authentication, authorization, rate limits, or security;
- reverse engineer or scrape the Service except where law expressly permits it;
- share credentials, impersonate others, falsify results, or manipulate participation;
- use automated access that burdens the Service without our written permission; or
- use Realm or its AI output to make high-impact decisions about employment, admissions, credit, housing, healthcare, insurance, or legal rights.
- configure AI grading to identify, infer, or score a person’s race, ethnicity, religion, health, disability, sexual orientation, biometric identity, emotions, or other sensitive traits.
We may remove content or restrict activity that we reasonably believe violates these Terms or creates risk to users, Realm, or third parties.
7. Location features and physical safety
Location boundaries, device GPS, maps, tiles, QR codes, and network conditions may be delayed, incomplete, or inaccurate. A successful location check means only that the submitted device coordinates matched the configured rule at that moment; it does not confirm identity, continuous presence, authorization to enter, or safe conditions.
Organizers must inspect routes and locations, obtain property permissions, provide accessibility and emergency alternatives, account for weather and local conditions, and avoid requiring participants to trespass, drive while using Realm, enter hazardous areas, or ignore instructions from authorities. Participants must use reasonable care, follow applicable rules, and stop an activity if conditions appear unsafe.
8. AI-assisted features
If AI-assisted grading is turned on for a task, Realm may use a third-party model to evaluate eligible text or photo submissions. If you use AI game generation, Realm sends your brief, venue information, and satellite imagery of the venue to a third-party model, requests that imagery from a third-party imagery service, and queries a public map-data service, then returns a draft that you must review before publishing. If you use the AI draft assistant, Realm sends your messages and the draft’s text to a third-party model. AI output is probabilistic and may be incomplete, biased, or incorrect. Organizers remain responsible for task design, review standards, appeals, and any action taken from a result. Participants should have a reasonable way to request human review of an AI-assisted result.
You may not submit content to an AI-enabled task, game-generation request, or AI draft-assistant request, including messages and draft content, that you lack permission to process with third-party AI providers. Realm does not represent that AI output is accurate, unique, non-infringing, or suitable for any professional or high-impact purpose.
9. Paid plans and billing
- Prices, included usage, billing frequency, and plan features are shown at checkout. Taxes may be added where required.
- Paid subscriptions renew automatically for the same period until canceled through the billing portal or another method we provide.
- Cancellation stops future renewal and normally takes effect at the end of the current paid period. Except where law requires otherwise, fees already paid are non-refundable.
- We may change prices or plan limits with advance notice. Changes apply no earlier than the next renewal unless you agree otherwise.
- If payment fails or a subscription ends, we may limit access to paid features or return the workspace to the functionality available on a free plan.
Stripe processes payments. Its terms may apply to payment methods and billing services. Workspace owners and authorized administrators are responsible for purchases and for keeping billing information current.
10. Third-party services
The Service depends on third-party services for authentication, infrastructure, storage, billing, maps, map data, email, and optional AI processing. Their own terms and privacy policies may apply to features they provide directly. Realm is not responsible for third-party sites, content, or services outside our control, but this does not limit obligations we have for providers processing information on our behalf.
11. Suspension and termination
You may stop using Realm at any time and may request account deletion from Account settings, including while your account is suspended. We may suspend or terminate access if you materially breach these Terms, create a security or safety risk, fail to pay applicable fees, or if law requires us to do so. For serious abuse, content we reasonably believe is illegal, or a risk to the safety of players or others, we may suspend access immediately and without prior notice; we will then notify you by email with the general reason and you may appeal by contacting support@playonrealm.com. In other cases, we will provide notice and a reasonable opportunity to cure when appropriate.
On termination, your right to use the Service ends. Provisions that by their nature should survive will survive, including ownership, payment obligations, disclaimers, liability limits, indemnification, and dispute terms. Content retention and deletion are governed by the Privacy Policy, workspace controls, and any applicable organization agreement.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” REALM AND ITS AFFILIATES, LICENSORS, AND PROVIDERS DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
We do not warrant that the Service will be uninterrupted or error-free, that content or results will be accurate, that data will never be lost, or that location and AI features will work in every environment. These disclaimers do not exclude warranties or consumer rights that cannot be waived under applicable law.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALM AND ITS AFFILIATES, LICENSORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU OR YOUR ORGANIZATION PAID REALM FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US$100.
These limits apply regardless of the theory of liability and do not apply where prohibited by law or to liability that cannot legally be limited.
14. Indemnification
If you use Realm for an organization or commercial purpose, you and that organization will defend, indemnify, and hold harmless Bisaic, its affiliates, and their personnel from third-party claims, losses, and reasonable costs (including attorneys’ fees) arising from your User Content, your Games, Sessions, Challenges, or participant instructions, your violation of these Terms or law, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from Realm’s own breach, negligence, or willful misconduct. Consumer users are responsible only to the extent permitted by applicable law.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and each party consents to their jurisdiction and venue.
Before filing a claim, you and Realm agree to try in good faith for 30 days to resolve the dispute informally after written notice. Nothing in this section prevents either party from seeking urgent injunctive relief, and it does not override non-waivable consumer protections or forum rights where you live.
16. General terms
We may update these Terms to reflect changes to the Service, law, or risk. We will post the revised Terms with a new effective date and provide additional notice for material changes when required. If you continue using the Service after revised Terms take effect, you accept them; if you do not agree, you must stop using the Service.
You may not assign these Terms without our written consent. We may assign them as part of a merger, reorganization, financing, or sale of the business. Failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. These Terms, the Privacy Policy, plan terms, and any applicable signed organization agreement are the entire agreement about the Service and replace prior discussions on that subject.
